By accessing and using Real Estate OS ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these terms, you should not use this service.
Real Estate OS is a software-as-a-service platform designed to help real estate professionals manage their business, leads, and client relationships. The service includes web-based tools, mobile applications, and communication features including SMS messaging.
By providing your mobile phone number and opting-in to receive SMS messages from Real Estate OS, you expressly consent to receive text messages from us. This consent is not required as a condition of purchase.
You may receive the following types of messages:
Message frequency varies based on your account activity, preferences, and the services you use.
Message and data rates may apply. You are responsible for any charges from your wireless carrier for text messages. Check with your carrier for details on your messaging plan and charges.

Carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission from your network operator and is outside of our control.
This SMS program complies with the Telephone Consumer Protection Act (TCPA). We will not send you messages without your prior express written consent, except as permitted by law. Your consent is documented and stored in accordance with TCPA requirements.

The service and its original content, features, and functionality are owned by Derek Middlebrook PLLC and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Some services may require payment. You agree to pay all charges incurred by you or on your behalf through the service, at the prices in effect when such charges are incurred. We reserve the right to change our pricing at any time.
We strive to maintain high availability of our service but cannot guarantee uninterrupted access. The service may be temporarily unavailable due to maintenance, updates, or unforeseen technical issues.
In no event shall Derek Middlebrook PLLC or Real Estate OS be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.
We may terminate or suspend your account and access to the service immediately, without prior notice, for conduct that we believe violates these terms or is harmful to other users of the service, us, or third parties.
These terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions.
We reserve the right to modify or replace these terms at any time. If a revision is material, we will provide notice prior to any new terms taking effect.
